It's not an illegal search if the scent of any narcotics is obvious. That is probable cause.

Actually I wasn't even talking to you. If you're going to drive around with such an obvious scent that there's no denying it you deserve what you get. If they can see the smoke and smell it then obviously you can't do anything about that.
